Ofwat has powers to determine disputes under the Guaranteed Standards Regulations about a customer’s right to payment or credit under the Guaranteed Standards Scheme (GSS).
Competition Act 1998 cases
Ofwat has concurrent powers to enforce and apply the Competition Act 1998 (CA98). This prohibits conduct, agreements and business practices that damage competition in the United Kingdom.
Enforcement action
Where companies fail to meet their obligations, we have enforcement powers under the Water Industry Act 1991. To secure compliance and change behaviour we can obtain legally binding undertakings and impose enforcement orders. For the most serious contraventions we can impose financial penalties on companies.
