Application of the Water Supply and Sewerage Services (Customer Service Standards) Regulations 2008
You have already been notified by Defra or Welsh Assembly Government that the Water Supply and Sewerage Services (Customer Service Standards) Regulations 2008 came into force on 1 April 2008. These regulations (the 2008 GSS Regulations) implement our recommendations to government as set out in RD06/07.
In brief, the 2008 GSS Regulations extend provisions to include a minimum payment for internal sewer flooding and to include external sewer flooding. The 2008 GSS Regulations also consolidate all previous amendments.
You will need to consider how best to inform customers of their rights in respect of external sewer flooding under the 2008 GSS Regulations and make sure that your customer information and website is updated. You will also need to make sure you have established systems and procedures to secure compliance with the new regulations and ensure you are able to provide data to us that is reliable, accurate and complete.
We have updated our guidelines for dealing with customers affected by sewer flooding to reflect the 2008 GSS Regulations. These are available on our website.
Consultation on application of weather exemptions
The 2008 GSS Regulations continue to exempt companies from making payments where the failure of prescribed standards is because of severe or exceptional weather. In RD06/07, we said we would consult on draft guidance to assist companies and customers in understanding how these weather exemptions may be applied. Our consultation on this can be found here. We welcome your response by 19 September 2008.
