DEVELOPING OUR PROCESS FOR ASSESSING CAPITAL MAINTENANCE REQUIREMENTS

In MD212 we discussed the issues arising from the UKWIR review of the common framework, and set out our expectation that companies will continue to improve their forward-looking analysis of the economic level of capital maintenance. We also said we would consult on options for our assessment process.

The consultation paper attached to this letter sets out some initial thinking. On most of the issues discussed in the paper we do not set out firm proposals, but are seeking an open dialogue with the industry and interested stakeholders.

We will also hold a workshop on 10 May 2006 to help in considering your response. We will send further details within the next few weeks.

The Water Services Regulation Authority will consider the responses to this paper before it reaches decisions on the approach that Ofwat will take at PR09.

Section 6 in the paper sets out the questions on which we seek your views.
