This consultation document sets out the findings of our Water Industry Act 1991 (‘WIA91‘) investigation into Welsh Water and the breaches of its regulatory obligations. It includes a Provisional Penalty Notice (‘the Notice’) setting out Ofwat’s intention to issue Welsh Water with a nominal financial penalty of £1 under section 22A(1) WIA91 in light of Welsh Water’s offer of undertakings to address the breaches, including direct benefits to customers totalling £39.4 million.  

Ofwat has concluded that Welsh Water misreported data on leakage and per capita consumption (‘PCC’) over several years, and that it has failed to have in place adequate systems of management, planning and internal control in relation to its leakage and PCC management and reporting.   

The Notice is the result of a thorough investigation, following Welsh Water’s self-referral to Ofwat that it had misreported regulatory data to us.  

As required by section 22A(4) WIA91, Ofwat is publishing this Notice to allow representations to be made on our proposal. Following consideration of any, and all, responses to the consultation, we will then make our final decision.
